(“Marklo”, “we”, “us”, or “our”) collects, uses, stores, and discloses personal data when you visit our website, use our platform, or otherwise interact with us. Please read this policy carefully. By using our Services, you agree to the practices described herein.
Our Services are designed for businesses — specifically marketing teams, agencies, and operators of Shopify-based DTC brands — and are not intended for personal or household use.
1. Who We Are
Marklo AI, Inc. is a software company that develops and operates an AI-powered marketing platform for Shopify DTC brands. Our platform helps marketing teams and their partners plan campaigns, forecast revenue, analyze performance, and generate AI-powered marketing insights.

2. Information We Collect
We collect personal data in the following ways:
2.1 Information You Provide Directly
• Account registration details (name, email address, company name, job title)
• Billing and payment information (processed by our payment provider; we do not store full card details)
• Communications with us, including support requests, survey responses, and partner applications
• Any content or data you upload or input into the platform
2.2 Information We Collect Automatically
• Usage and activity data (pages visited, features used, actions taken within the platform)
• Device and browser information (IP address, browser type, operating system, device identifiers)
• Log data (access times, referring URLs, error logs)
• Cookies and similar tracking technologies (see Section 6)
2.3 Information from Third-Party Integrations
To provide our Services, Marklo connects with third-party platforms at your direction. When you authorize these integrations, we may receive data from:
• Shopify (store performance, product data, order data)
• Klaviyo (email and SMS campaign performance, audience data)
• Meta (Facebook and Instagram ad performance, organic post and campaign performance, and audience insights)
• Google Ads and Google Analytics (campaign and traffic data)
• Other marketing platforms and data sources you choose to connect
We access this third-party data solely to provide the Services you have requested. We do not use data obtained through third-party integrations for any purpose that is inconsistent with the authorization you grant or the terms of those platforms.
2.4 Information from Partners and Third Parties
We may receive information about you from business partners, referral sources, or publicly available sources, which we may combine with other information we hold about you.
3. How We Use Your Information
We use personal data for the following purposes:
To operate, maintain, and improve the Marklo platform and Services
To authenticate users and manage account access
To process payments and manage billing
To provide customer support and respond to inquiries
To send service-related communications (e.g., account activity, security alerts, product updates)
To send promotional communications about Marklo features, events, and offers (you may opt out at any time)
To analyze how users interact with our Services and improve user experience
To operate and improve the platform using aggregated and de-identified data that does not identify you (Marklo does not train AI models on your personal data — see Section 4)
To detect, prevent, and address fraud, security incidents, and misuse
To comply with applicable legal obligations
To pursue our legitimate business interests, including marketing and business development
We do not sell your personal data to third parties.
4. AI and Data Processing
Marklo uses artificial intelligence to generate campaign recommendations, revenue forecasts, performance insights, and marketing briefs. To deliver these features, we may process data from your connected integrations — including campaign performance data, store data, and product information — using AI models, including third-party large language models (LLMs).
Where third-party AI providers are involved, we share only the minimum data necessary to generate insights, and such data is processed in accordance with our agreements with those providers. Marklo does not train, fine-tune, or retrain any AI or machine-learning models — its own or third parties’ — on your personal data, and does not submit your personal data to any model-training loop or dataset. Our third-party LLM providers operate under enterprise agreements that prohibit them from training their foundation models on customer inputs and outputs. Marklo may use aggregated and de-identified data, which does not identify you, to operate and improve the platform.
Marklo’s use of data obtained via Google APIs complies with the Google API Services User Data Policy, including the Limited Use requirements.
5. Data Sharing and Disclosure
We may share personal data in the following circumstances:
5.1 Service Providers
We engage trusted third-party vendors to help us operate our Services, including cloud hosting, payment processing, analytics, customer support, email delivery, and security monitoring. These providers access personal data only as needed to perform services on our behalf and are bound by confidentiality obligations.
5.2 Business Partners
If you engage with Marklo through a partner (such as an agency or reseller), we may share relevant account information with that partner as necessary to deliver the Services.
5.3 Legal Compliance and Safety
We may disclose personal data if we believe in good faith that such disclosure is necessary to comply with a legal obligation, respond to a valid legal request, protect the rights or safety of Marklo, our users, or the public, or to detect or prevent fraud or misuse.
5.4 Business Transfers
If Marklo is involved in a merger, acquisition, asset sale, or other business transaction, personal data may be transferred as part of that transaction. We will provide notice before personal data becomes subject to a materially different privacy policy.
5.5 With Your Consent
We may share your information in other ways if you have given us your explicit consent to do so.
5.6 AI Assistants You Connect (MCP)
If you choose to connect a third-party AI assistant — such as Anthropic’s Claude — to your Marklo workspace using the Model Context Protocol (“MCP”), personal data and other information in your workspace (such as campaign, performance, and account data) may be shared with and processed by that AI assistant at your direction. This sharing is initiated and controlled by you, not by Marklo; Marklo does not proactively share your data with any AI assistant absent your affirmative connection and configuration. You can review, adjust, and revoke MCP connections at any time from your account settings. Data handling by the connected AI assistant is governed by that provider’s own terms and privacy practices, which we encourage you to review. This is separate from Marklo’s own use of third-party large language models described in Section 4 (AI and Data Processing), which Marklo initiates internally to generate outputs within the platform.
6. Cookies and Tracking Technologies
We use cookies and similar technologies to operate our Services, analyze usage, personalize your experience, and support our marketing activities.
Types of cookies we use:
Essential cookies: Required for the platform to function (e.g., authentication, session management)
Analytics cookies: Help us understand how users interact with our Services
Preference cookies: Remember your settings and preferences
Marketing cookies: Used to measure the effectiveness of our advertising
You can manage your cookie preferences through your browser settings. Disabling certain cookies may limit your ability to use some features of the platform.
7. Data Retention
We retain personal data for as long as necessary to provide our Services, maintain our business relationship with you, comply with legal obligations, resolve disputes, and enforce our agreements.
When your account is closed or data is no longer required, we will securely delete or anonymize your personal data, unless we are required to retain it by law. Where a separate written agreement between Marklo and a customer specifies a different data retention or deletion timeline, the terms of that agreement will govern.
8. Data Security
We implement industry-standard technical and organizational measures to protect your personal data against unauthorized access, loss, disclosure, or misuse. These include encryption in transit and at rest, access controls, and regular security reviews.

9. Your Rights
Depending on your location and applicable law, you may have the following rights with respect to your personal data:
Access: Request a copy of the personal data we hold about you
Correction: Request that we correct inaccurate or incomplete data
Deletion: Request that we delete your personal data, subject to certain exceptions
Restriction: Request that we limit how we process your data
Portability: Request a copy of your data in a portable format
Objection: Object to our processing of your data in certain circumstances
Withdraw consent: Where processing is based on consent, withdraw that consent at any time

10. Communications
10.1 Service Communications
We will send you communications necessary to operate your account and deliver our Services, such as billing notices, security alerts, and product updates. You cannot opt out of essential service communications.
10.2 Promotional Communications
With your consent or where otherwise permitted by law, we may send you marketing emails about Marklo features, events, and partner opportunities. You can unsubscribe at any time by clicking the “unsubscribe” link in any marketing email or by contacting us at hello@marklo.ai.
11. Children’s Privacy
Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal data from minors. If we become aware that we have collected personal data from a minor without appropriate consent, we will take steps to delete it promptly.
12. International Data Transfers
Marklo is headquartered in the United States. If you are located outside the United States, please be aware that your personal data may be transferred to and processed in the United States or other countries where our service providers operate. We take appropriate safeguards to ensure such transfers comply with applicable data protection laws.
13. Third-Party Links and Services
Our platform may contain links to third-party websites or integrate with third-party services. This Privacy Policy does not apply to those third parties. We encourage you to review the privacy policies of any third-party services you connect to or access through Marklo.
14. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date at the top of this page and, where changes are material, notify you by email or through the platform. Your continued use of our Services after any update constitutes your acceptance of the revised policy.
15. Additional Information for California Residents
This section applies to residents of California and supplements the rest of this Privacy Policy. It is provided pursuant to the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020 (together, “CCPA/CPRA”).
Categories of Personal Information Collected
In the past 12 months, we have collected the following categories of personal information as defined under the CCPA:
Identifiers — such as name, email address, IP address, and account credentials
Commercial information — such as subscription details and billing records
Internet or electronic network activity — such as platform usage data, pages visited, and features used
Professional or employment-related information — such as job title and company name
Inferences — derived from the above to generate campaign recommendations and marketing insights
We collect this information for the business purposes described in Section 3 of this Privacy Policy.
Sale or Sharing of Personal Information
Marklo does not sell your personal information for monetary consideration. We do not share your personal information with third parties for cross-context behavioral advertising purposes. You therefore do not need to opt out of any sale or sharing of your personal information by Marklo.
Your California Privacy Rights
California residents have the following rights under the CCPA/CPRA:
Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the sources, our purposes for collecting it, and the categories of third parties with whom we share it.
Right to Delete: You may request that we delete personal information we have collected from you, subject to certain exceptions.
Right to Correct: You may request that we correct inaccurate personal information we maintain about you.
Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not deny you Services, charge you different prices, or provide a different level of service because you exercised your privacy rights.
How to Submit a Request
To exercise any of your California privacy rights, please contact us at hello@marklo.ai with the subject line “California Privacy Request.” We will respond to verifiable requests within 45 days. If we need more time, we will notify you and may extend our response period by an additional 45 days.
We may need to verify your identity before fulfilling your request. We will not fulfill requests we cannot verify.
Shine the Light
California Civil Code § 1798.83 permits California residents to request information about our disclosure of personal information to third parties for their direct marketing purposes. Marklo does not share personal information with third parties for their own direct marketing purposes.
